FUNERIA® TERMS OF SALE

All artwork is subject to prior sale, discontinuation and price change without notice. Availability, prices, and estimated ship dates will be confirmed upon order receipt. Payment in full is due upon order confirmation.

DELIVERY TIMES: Some artwork may be available for overnight delivery, while others-especially Special Orders and personalized or commissioned work-may require from two to ten weeks from order confirmation to shipment. Delivery times may vary based on the variety of styles you order. Estimated ship dates will be confirmed with your order.

PACKING/SHIPPING: Artwork is shipped FOB. Unless directed otherwise, FUNERIA will arrange for shipping, handling and insurance for your account. Such costs are in addition to the price and will be confirmed with order confirmation. INTERNATIONAL SHIPPING: Unless otherwise indicated with order confirmation, all points of origin are located within North America. At the point of destination, the recipient will be responsible for payment of any duties, taxes, tariffs or brokerage service fees that may apply. Orders being purchased from outside the U.S. must be paid with U.S. funds drawn on a U.S. bank.

DAMAGES IN SHIPPING: Please inspect artwork upon receipt. Should your order incur damage during shipment, note the damages and contact FUNERIA immediately so that we can help you process the claim and replace the item as necessary. It is important to keep the artwork with its original packing material and container so that it can be properly examined by the carrier. A photo of the damaged item, along with its packing material, may be helpful. Artwork that is not immediately inspected and is later determined to be damaged may not be eligible for return or refund.

RETURNS/REFUND POLICY: Artwork in the FUNERIA Portfolio may be created or finished by the artist only upon their receipt of the order. Only artwork that is defective, or was not what you ordered may be returned for a refund. FUNERIA will pay return shipping costs only in such circumstances. Please call or e-mail us for return authorization as soon as you have examined your shipment and not more than 7 days from its receipt if any of these circumstances apply so that we can arrange pick up. If a refund is due, it will be given in the same form of payment originally used to purchase the artwork, within a reasonable time of receiving the returned item. Shipping and related delivery costs to your shipping address will not be credited unless an error was made on our part.

PAYMENT AND SALES TAX: Payment is due upon order confirmation and may be made by check, money order, credit card (VISA, MasterCard and American Express), or wire transfer. Prices are exclusive of sale, use or other similar taxes imposed on the sales, and shall be stated as a separate line item, if applicable (unless you are exempt from such taxes or have provided FUNERIA a re-sale certificate).

OWNERSHIP: Artists or FUNERIA retain all rights of ownership to their original works. All images, text, and contents of the FUNERIA Portfolio, in printed, electronic and all other forms, are the intellectual property of FUNERIA or the artists whose work is represented. Unless the Artwork is purchased for resale (in which event, FUNERIA's resale terms shall apply), the artwork and any materials related to the artwork may not be duplicated, copied, paraphrased, referenced or distributed in any form without the prior written consent of FUNERIA. Purchaser agrees not to cover, replace or otherwise alter the artist’s signature and/or FUNERIA mark appearing on the artwork and to ensure that the FUNERIA brand is used in connection with the artwork.

WARRANTY DISCLAIMER, LIMITATIONS OF LIABILITY: While each artist strives for consistency in creating their work for FUNERIA, purchasers acknowledge that each object is a work of art, with many handcrafted features, and that some variations in the artwork as represented will occur. Neither FUNERIA, nor anyone associated with FUNERIA in any capacity, will be liable at any time for how artwork is handled or used or for any direct, indirect, incidental or any other class of damages in connection with its use once it is in the possession of the purchaser. All of the information provided here and throughout the FUNERIA Portfolio, website, or other promotional and sales materials was believed to be correct when published but may contain errors.

IMPORTANT INFORMATION ABOUT FUNERIA® PORTFOLIO ARTWORKS

The FUNERIA® Portfolio includes a broad selection of sizes and capacities. The best resource for determining the size vessel you will need is a funeral service professional. Typically, however, the weight of an individual at death is equivalent to the number in cubic inches required for cremated remains. Therefore, a 200 lb. individual would minimally require a 200 cubic inch capacity urn. If the size you are seeking is not listed with the artwork, you may wish to consider commissioning a Special Order that can be customized in any number of respects, including special sizing, color combinations and/or personalization. You may also wish to choose more than one vessel-such as a combination of both keepsake and larger sizes-for sharing the cremated remains.

Like those they are intended to honor, each work of original art in the FUNERIA Portfolio reflects unique characteristics that are inherent in the material from which they are created. If the artwork is to be used as an urn to contain ashes at home-where it may be subject to occasional handling or movement-it is important to treat each vessel as a work of fine art-with great care. Artwork represented by FUNERIA is neither water nor air-tight. For extra assurance that ashes remain intact, we recommend that they be kept in the resilient liner in which they were likely received from the crematory operator. Sealing and care suggestions are included with each artwork.
